Telling a real route from a scam
The markers of a follow-up fraud: a guaranteed result, an upfront "unlocking fee" or a "commission for releasing the funds we found", and promises to hack or reverse a transaction. The blockchain is irreversible: only whoever holds the funds now can return them — voluntarily or under compulsion from a court.
What works
- Tracing. Professional analysis of the movement of funds to the point where they can be reached — most often an exchange, where the thief moved the assets to cash out.
- A rapid freeze at the receiving exchange. Notifying the platform's compliance team with evidence of the theft. The window is hours and days: it works while the funds are still there.
- A report to law enforcement — an essential step: without a criminal case an exchange will only freeze funds briefly, and it can only disclose the account holder on an official request.
- A civil claim with interim relief — including claims against persons unknown with disclosure orders served on the exchange.
An honest view of the odds
The odds are meaningful when little time has passed, the sum justifies the costs, and the funds have landed on a regulated platform. They are minimal when the funds went through a mixer into opaque jurisdictions months ago. We say so plainly at the first consultation — before you spend money on the process.
The legal toolkit that actually recovers funds
Serious recovery work combines blockchain forensics with court orders. The tracing comes first — professional tools (Chainalysis Reactor, Elliptic, TRM Labs) follow the funds to an off-ramp, usually a regulated exchange. Then the law takes over: English courts, which lead this field, have confirmed that crypto-assets are property capable of being frozen (AA v Persons Unknown [2019] EWHC 3556 (Comm)) and routinely grant freezing (Mareva) injunctions against “persons unknown” — the fraudsters’ identities need not be known before filing. Disclosure orders against the exchange holding the funds — Norwich Pharmacal and Bankers Trust orders — then compel it to reveal whose account received them, converting an anonymous trail into a defendant with a name. Cross-border enforcement runs through the exchanges’ own compliance freezes and, where criminal proceedings exist, mutual legal assistance between states.
The pattern we see most is the long-contact investment fraud (“pig butchering”), where victims transfer repeatedly over months — which is precisely why speed matters more than the amount: funds still sitting on a regulated venue can be frozen; funds dispersed through mixers usually cannot.
The honest answer is that timing matters more than almost anything else in a recovery case — funds sitting on a regulated exchange today can often be frozen within hours if we move fast and the exchange’s compliance team responds to a properly evidenced report. The same funds a month later, split across a mixer and out to unregulated venues, are usually gone. We’d rather tell a client that on day one than take a fee pretending otherwise.
